The commercial company Smart Dental Clinic s.r.o., Fialová 4, 851 07 Bratislava, Company ID: 52 346 986, VAT ID: 2121009055, registered in the Commercial Register of the District Court Bratislava I, insert no. 137352/B, section: Sro (hereinafter referred to as “Smart Dental Clinic”) issues these terms and conditions (hereinafter referred to as “T&C”), which regulate the relationships between the buyer, or the holder of a gift voucher, and Smart Dental Clinic.
Definition of Terms
Gift Voucher (hereinafter referred to as 'voucher') is a voucher for payment for services in the value specified on the voucher.
Voucher Order is the purchase of a voucher at www.smartdental.sk/darcekove-poukazky.
Voucher Purchaser is the person who placed the voucher order and subsequently paid for the voucher.
Voucher Holder / Voucher Recipient is the voucher purchaser or the person gifted by the purchaser who will then redeem the voucher.
Voucher Order
The voucher can be purchased at www.smartdental.sk/darcekove-poukazky.
Types of Vouchers:
- Vouchers for any amount for any service provided by Smart Dental Clinic. The purchaser chooses the voucher amount. However, the minimum voucher value is 30 Euros and the maximum voucher value is set at 1000 Euros.
- Vouchers for a specific value for specific services
When purchasing a voucher, the purchaser chooses whether they are buying it for themselves or wish to gift it to someone else. They then fill in the buyer's first and last name, and potentially the first and last name of the voucher recipient (the gifted person) if the purchaser wishes to gift the voucher to another person, as well as a phone number.
The purchaser then has the option to choose whether to print the voucher immediately after payment or have it sent to the email address provided in the form. If they choose the 'print' option, they can download the purchased voucher at any time.
Each purchaser will also receive a purchase confirmation for the voucher to the email address they provided.
Smart Dental Clinic sells vouchers exclusively in electronic form (with the option for the purchaser to print at home) via www.smartdental.sk/darcekove-poukazky – the voucher is delivered to the email address provided during the voucher order. The email includes the voucher code, voucher value, validity period, basic instructions for redemption, information on who the voucher is intended for redemption, and the option to download the voucher.
A service fee of 3% of the voucher amount is charged for the purchase of a voucher.
By purchasing a voucher, you agree to these Terms and Conditions.
Payment method
Card payment – VISA, Master-Card, American Express, PayPal, DIRECT Debit, and BANK TRANSFER. Immediate payment crediting and instant dispatch of the electronic voucher version to your home for printing.
Voucher Delivery
The voucher is sent to the provided email address the moment payment is credited to Smart Dental Clinic's account.
We are not responsible for incorrectly entered email addresses or unforeseen circumstances.
Voucher Validity
The voucher and the credit on the voucher itself are valid for 12 months from the date of purchase. After the validity period expires, the voucher cannot be redeemed, renewed, or its unspent value/credit refunded.
The voucher holder can use the voucher until the card balance is zero.
The voucher holder can check the remaining credit on the voucher and its validity at any time via www.smartdental.sk/darcekove-poukazky.
Voucher Redemption / Usage
The voucher can be redeemed at Smart Dental Clinic in Bratislava and Poprad.
Voucher redemption must be reported at the reception upon arrival at the clinic.
The voucher can be used to pay for the full or partial value of a selected service at the clinic.
If the voucher value exceeds the amount billed for the service provided to the voucher holder, the voucher holder may use the remaining credit for another service. No change will be given from the voucher.
If the voucher does not cover the billed amount for the service provided, the voucher holder shall pay the remaining amount by other means (e.g., cash, invoice payment).
The voucher contains a unique 5-digit code and a barcode for identification, which must be presented at the reception upon redemption.
Seller's Obligations
Smart Dental Clinic undertakes to deliver ordered and paid vouchers to the specified email address.
Smart Dental Clinic undertakes to enable voucher redemption within its validity period – 12 months from purchase.
Limited Liability
After the purchase of the voucher, Smart Dental Clinic is not responsible for its subsequent loss, theft, deactivation, or damage. Treat the voucher as cash!
Complaints and Warranties
The Smart Dental Clinic where the service was provided is responsible for complaints regarding a service purchased with a voucher.
Withdrawal from the Contract
The consumer is entitled to withdraw from the contract without stating a reason, in accordance with Section 7 of Act No. 102/2014 Coll. on consumer protection in the sale of goods or provision of services based on a distance contract or a contract concluded off-premises and on the amendment and supplementation of certain acts as amended by later regulations, within 14 days from the date of concluding the contract for the provision of digital content not supplied on a tangible medium.
You are obliged to exercise the right to withdraw from the contract in written form or as a record on another durable medium (e-mail). The withdrawal period is considered to be observed if you sent the notice of withdrawal from the contract no later than the last day of the period.
If you wish to cancel the contract, please notify us at[email protected], and we will provide you with further information regarding the cancellation, including a cancellation form.
By withdrawing from the contract, the contract for the provision of digital content not supplied on a tangible medium is cancelled from the beginning. The paid amount will be refunded to you no later than within 14 days to the bank account from which the voucher payment was made, or to another account if you specify it in the contract withdrawal.
The voucher cannot be exchanged for cash.
Personal Data Protection
Smart Dental Clinic processes personal data provided during the purchase of a voucher, acting as a data controller.
The provision of vouchers is carried out in accordance with applicable personal data protection regulations, which include Regulation (EU) No. 2016/679 (hereinafter referred to as "GDPR"), as well as all other applicable legal regulations governing the processing of personal data, including, where applicable, Directive No. 2002/58/EC concerning the processing of personal data and the protection of privacy in the electronic communications sector and Act No. 18/2018 Coll. on personal data protection.
Purpose of Processing
The purpose of processing personal data under these terms and conditions is the provision of vouchers.
Legal Basis for Processing
Personal data processed under these terms and conditions is processed by Smart Dental Clinic, acting as the controller, based on the legal grounds defined in Article 6, paragraph (1), letter b) of the GDPR.
Duration of Processing
The duration of processing for the specified purpose corresponds to the duration of the business relationship between the data subject as the buyer and Smart Dental Clinic as the seller. If personal data of a person other than the buyer is processed, this personal data may not be processed for a period longer than that specified for processing under the first sentence.
Nature of Processing
It represents voucher services as described in these Terms and Conditions.
Type of Personal Data
We process personal data of customers: voucher buyers; and/or voucher recipients or other individuals whose personal data is processed as part of the voucher services in accordance with these Terms and Conditions.
The aforementioned data includes the name, surname, email address, phone number, and bank details of these data subjects.
Special categories of personal data, including data related to criminal convictions, are not considered to be processed within the scope of voucher services and are excluded from the processing conditions for the purpose of selling commercial vouchers.
When processing personal data for the stated purpose, Smart Dental Clinic does not provide this data outside the European Union or the European Economic Area. The recipients of this personal data may only be state administration bodies in the exercise of their supervision over Smart Dental Clinic's activities, and only if explicitly mandated by law.
Smart Dental Clinic may provide the aforementioned personal data to a processor only for the purpose of ensuring the smooth provision of voucher services in accordance with these Terms and Conditions.
Smart Dental Clinic does not profile personal data obtained for the purposes stated in these Terms and Conditions.
Categories of Data Subjects
Data subjects include customers – voucher buyers and voucher recipients, and any other individuals whose personal data is processed for the purpose of providing voucher services.
